On February 1, 1999, the Massachusetts Department of Telecommunications and Energy (“MDTE”) issued an order (the “Order”) addressing, among other things, issues relating to the contract renewal and supply planning process of the local distribution companies. In the spirit of that Order, Bay State Gas Company (“Bay State”) has listed below the following potential changes to its portfolio.

Notification of renewal or termination of the contracts listed above must be submitted by October 31, 2007 or sooner. Currently, Bay State intends to renew or replace all of these contracts. Consistent with its MDTE approved planning standards, Bay State intends to compare all contracts with alternatives solicited by Bay State under its standard RFP process. Existing contracts will only be renewed if they can be determined to be superior to all alternative proposals submitted.
